Terms of Service
The agreement between you and AffirmPax — the short version first, then the full terms.
The short version
Who can use AffirmPax
AffirmPax is for adults only. You must be 18 or older (or the age of majority where you live) and able to enter a binding agreement to use the service.
Consent records
AffirmPax helps two people record a mutual, voluntary agreement. A record reflects what both parties affirmed at a moment in time. It is not legal advice, and consent can always be withdrawn — an existing record never obligates anyone to anything in the future.
Acceptable use
- Be honest. Don’t impersonate anyone or falsify verification.
- Don’t use AffirmPax to coerce, pressure, or harm another person.
- Don’t use the service for anything illegal.
Your responsibilities
Keep your account secure and your verification truthful. You’re responsible for the agreements you choose to enter and the people you choose to enter them with.
Changes
We’ll update these terms as the product grows and post the current version here, with the effective date noted at the top.
Full terms of service
These Terms are a legal agreement between you and AffirmPax, Inc., a Delaware corporation (“AffirmPax”, “we”, “us”), governing your use of our website (affirmpax.com) and, when it launches, the AffirmPax mobile app (together, the “service”).
1. Acceptance of these terms
By accessing or using the service, you agree to these Terms, our Privacy Policy, and our Data Sharing Policy. If you do not agree, do not use the service.
2. Eligibility
You may use AffirmPax only if you are at least 18 years old (or the age of majority where you live), have the legal capacity to enter a binding agreement, and are not barred from using the service under any applicable law. The service is strictly for adults.
3. What AffirmPax is — and is not
AffirmPax is a neutral tool that helps two adults record a mutual, voluntary agreement. It is important that you understand its limits:
- AffirmPax is not a law firm and does not provide legal advice.
- A record reflects only what both parties affirmed at a point in time. It is not a guarantee that any court, authority, or other person will accept it as evidence of anything.
- Consent is ongoing and can be withdrawn at any time. An existing record never obligates anyone to any future conduct, and creating a record does not waive anyone’s rights.
- AffirmPax is neutral and is not a party to your agreement. We do not take sides and do not enforce agreements between users.
4. Your account and verification
You are responsible for keeping your account credentials secure and for activity that happens under your account. You agree to provide truthful verification information and not to falsify it. We may suspend or refuse accounts that fail or falsify verification, or that we reasonably believe are being misused.
5. Acceptable use
When using the service, you agree that you will not:
- Impersonate anyone, or provide false or falsified verification.
- Use AffirmPax to coerce, pressure, threaten, deceive, or harm another person.
- Use a record to blackmail, harass, “out”, dox, or retaliate against anyone.
- Use the service for any illegal purpose, or involve anyone under 18.
- Attempt to breach, probe, or circumvent the security of the service, or scrape or harvest data from it.
6. Consent records: nature and limits
A consent record is a timestamped account of what each party affirmed. It is not a license, not a waiver of any legal right, and not proof of anything beyond the parties’ own statements at that moment. Because consent is always revocable, a record can never compel future conduct. You are solely responsible for the agreements you choose to enter and the people you choose to enter them with.
7. Intellectual property
We own the service and everything in it except your data and content. You keep your rights in the content and information you submit, and you grant us a limited, revocable license to use it only as needed to operate and secure the service for you. You may not copy, modify, or reverse-engineer the service except as the law allows.
8. Third-party services
The service relies on third parties — for example, app stores, identity-verification providers, and hosting providers. Your use of those services is governed by their own terms, and we are not responsible for them.
9. Disclaimers
To the fullest extent permitted by law, the service is provided “as is” and “as available”, without warranties of any kind. We do not warrant that the service will be uninterrupted or error-free, that verification will detect every bad actor, or that any record will be accepted as evidence by any court, authority, or other person. Nothing in these Terms excludes any warranty or right that cannot be excluded under applicable law.
10. Limitation of liability
To the fullest extent permitted by law, AffirmPax will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, reputation, or goodwill. Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the 12 months before the claim, or USD 100. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you, and nothing here limits liability that cannot be limited by law.
11. Indemnification
To the extent permitted by law, you agree to indemnify and hold AffirmPax harmless from claims and costs arising out of your misuse of the service or your violation of these Terms or of the rights of another person.
12. Suspension and termination
We may suspend or terminate your access if you breach these Terms or applicable law, or to protect users or the service. You may stop using the service at any time and request deletion of your account and data, as described in our Privacy Policy.
13. SMS terms
By providing your mobile number in the AffirmPax app, you consent to receive a one-time verification passcode by SMS. By designating an emergency contact, you confirm you have that person’s permission; AffirmPax will notify them by SMS that they were designated and will text them a safety alert only if you trigger a safety check. Message frequency varies and is expected to be very low. Message and data rates may apply. Reply STOP to cancel at any time, or HELP for assistance (support@affirmpax.com). Carriers are not liable for delayed or undelivered messages. If your designated emergency contact opts out by replying STOP, we cannot deliver safety alerts to them.
14. Governing law and disputes
These Terms are governed by the laws of the State of Delaware, USA, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law in your country of residence applies. Before bringing a formal dispute, you agree to contact us so we can try to resolve it informally.
15. Changes to these terms
We may update these Terms as the product and the law evolve. We will post the current version here with a new effective date and, for material changes, give reasonable notice. Continuing to use the service after a change means you accept the updated Terms.
